A doctor or hospital that fails to recognize cancer, for example, can mean that the patient's undiagnosed and untreated cancer continues to spread. A failure to diagnose a fracture may cause a patient to need surgery weeks or months later that he never would have needed had his condition been timely diagnosed and treated. A 'failure to diagnose' assumes that you have a condition that should have been recognized. The key question that always arises in every failure to diagnose case is "If your condition had been timely diagnosed initially, would the treatment and outcome be the same?"
