They are tied together and one thing is sure: It is going to be very hard to see until they snap into their new orbits. Present financial crisis aside, it s going to take a concerted effort by the next administration to keep a regulatory environment in balance to provide just enough touch on the reins to steady but not impede broadband development in the next decade. And, at the same time, keep enough regulation in place to prevent the consequences of unregulated industries running open loop with no regard to the needs of the public . We have quite a graphic example of how well that works. The metered bandwidth Caps (250GB/month) are going to have a dampening effect on lots of operations. In fact, if it were not for Libsyn and RawVoice providing content hosting and bandwidth off for various SDRNews podcasts off the Comcast connection, I d be in deep red territory already. I am still concerned that I am going to tangle with the cap tripwire once I begin to add some video content in the next few months and increase my upload by streaming some content, uploading media for later release, and going about normal activities. Business models in the music industry have been broken for almost ten years, with television and movies not far behind. Once the bandwidth becomes available - FIOS or DOCIS 3 modems with fiber moving nodes ever closer , the business models are going to become less effective- and the caps are going to become far more relevan, especially for new media content producers. Which brings in the third element, which the FCC is starting to address: Product placement. It s hard to find a more convoluted opportunity for commercial speech than determining if or how product placement will be regulated. With the Tivo effect in full swing for OTA broadcast, cable and satellite, you can be sure that advertisers are going to make every effort to move into product placement, blatant and subliminal. And you can make sure that it s going to be making some law firms a good living for the next decade, at least. The most interesting part ? Even new media/podcasting/video is affected . It s coming, and if you look carefully, you can see which video content producers are paying attention. In a lengthy article, Ars Technica in essence spins the tale of a stalking horse that urges the public to fight internet pollution . Interesting term, defined in familiar ways to include viruses, spyware, malware, phishing attacks, and, incidentally, downloading of pirated content. Arts+Labs suggests that this internet pollution is the source of the congestion on the internet, and that by going through approved sites like Hulu.com, Veoh.com, Netflix, Joost, and so forth - the pipes will get cleaned and the world of limitless entertainment will be ours. If congestion is the problem, it looks like bits are bits. If there is some other problem - like control of content, then there is some serious misrepresentation going on. Who s behind Arts+Labs ? House Appropriations Committee s Subcommittee on Financial Services and General Government Hearing on Public, Educational, and Governmental (PEG) Access to Cable TelevisionFor immediate release September 18, 2008U.S House Subcommittee will ask FCC to examine harm to public, educational, and governmental acess television In response to testimony from Alliance for Community Media members yesterday, the House Appropriations Committee s Subcommittee on Financial Services and General Government voiced strong bi-partisan support for public, educational, and governmental (PEG) access for communities and asked the FCC to examine whether AT s New York chapter, and Executive Director of BronxNet, presented testimony that detailed multiple problems with PEG access channel delivery arising out of recent actions by the FCC, state legislatures, the cable industry and AT channel slamming ), reduced quality and functionality of existing channels, and loss or reductions in public cable drops to schools, libraries and other public centers. Regarding the issues of AT s treatment of PEG channels, Ms. Popovic said Bottom line, AT choice in cable franchising, is giving viewers no choice when it comes to PEG. Mr. Knobbe discussed the problems associated with channel slamming, which include additional costs to consumers to view PEG channels.FCC Media Bureau Chief Monica Desai agreed that at least one of these practices may be illegal, stating We believe that placing PEG channels on any tier other than the basic service tier may be a violation of the statute. When asked why the FCC was not enforcing that provision of the statute, Ms. Desai indicated that the FCC needed a formal complaint in order to act, and had not received any. In response, Subcommittee member Adam Schiff (CA-D) stated that he believed the FCC had authority to enforce the law whether or not they d received complaints.In closing, Subcommittee Chairman Serrano (NY-D) and Representative Kirk (IL-R) announced that they would send a letter to the FCC asking it to deal with the issues raised at the hearing.http://www.ourchannels.org/?p=202

It s only a shame that we did not have one thirty years ago. Block D was pulled during the auction last spring, as no bidder was willing to meet the $1.3 Billion reserve price, encumbered with the requirement that the allocations be shared with public health and safety systems on a secondary basis. The new auction is really two sets: one auction at the reduced reserve price of around $750Million for nationwide license to the spectrum block, the other for around sixty regional licenses that must be used for expansion using either LTE or WiMax technologies. As I understand the plan, if the nationwide block meets the reserve price, the winner gets to take all, including the public safety shared arrangement. If the nationwide block does not sell for the asking price, then the parallel regional licenses will go. The highest bidders and the winning technology will take all. WiMax or LTE, the losing bidders and technology will really lose. The winner will be named as the technology of choice. Contrast the crazy quilt of analog, CDMA,TDMA,GSM and additional frequency variants that we tolerated for thirty years in the US. That lack of standard and letting the market decide took time that can t be afforded today. At least someone is trying to make a decision. The market still decides - it just decides a lot more quickly.
